Home Office Pre-Appeal Review Process Under Independent Inspection
The Independent Chief Inspector of Borders and Immigration (ICIBI) has launched an inspection into the Home Office's pre-appeal review process and is inviting evidence from individuals and organisations with experience of the system. The call for evidence remains open until 24 June 2026.
What is the Pre-Appeal Review Process?
Before an immigration or asylum appeal progresses to the First-tier Tribunal, the Home Office reviews its original decision through its Pre-Appeals Review Unit (PARU). This stage provides an opportunity to identify errors, reconsider evidence and potentially resolve cases before they reach a tribunal hearing. The current inspection is expected to focus primarily on asylum and protection appeals, although evidence relating to other appeal types is also being sought.
What Will the Inspection Examine?
The ICIBI has outlined three key areas of focus:
The efficiency and effectiveness of the Pre-Appeals Review Unit as a quality control mechanism.
The role of PARU in driving improvement across asylum operations and policy.
The relationship and interaction between the Home Office and HM Courts and Tribunals Service during the appeals process.
The inspection will also consider how tribunal procedures and access to legal aid may impact the effectiveness of the Home Office's review process.
